Important: Standard Compensation

Parcel Horse provides up to £50 compensation per parcel for eligible loss or damage.
To increase your cover, you may purchase Declared Value Protection at checkout.

1. Introduction

These Terms & Conditions ("Terms") govern all parcel delivery and courier services provided by Cargo Northeast Ltd, trading as Parcel Horse ("we", "us", "our").

By booking or using our services, you agree to be legally bound by these Terms.

2. Definitions

  • Parcel Horse / We / Us – Cargo Northeast Ltd T/A Parcel Horse.
  • Customer / You – The person or business placing the booking.
  • Consignment / Parcel – Any item or group of items sent under one booking.
  • Carrier – Any subcontracted courier, airline, warehouse, or transport partner used by us.
  • Service – Any collection, handling, transportation, customs processing, storage or delivery we arrange.
  • Declared Value – Optional paid enhancement increasing our maximum liability.
  • Working Day – Monday to Friday, excluding public holidays.

3. Our Role

Parcel Horse provides parcel booking and transportation services using a network of domestic and international carriers.

We may transport items ourselves or subcontract to third-party carriers.

Regardless of subcontracting, your contract is always with Parcel Horse, within the limits of these Terms.

4. Customer Responsibilities

You confirm that:

  1. All information (weight, dimensions, contents, value, addresses) is accurate.
  2. You have authority to send the goods.
  3. Items comply with all legal, aviation, security, and customs rules.
  4. Packaging is suitable for international transit.
  5. No prohibited items are included.
  6. All customs documents are truthful and complete.

If any declaration is incorrect, you are fully liable for resulting costs, fines, or losses.

5. Prohibited Items (Strict – No Carriage, No Compensation)

The following must not be sent:

5.1 Valuable & High-Risk Items

  • Cash, banknotes, cheques, money orders
  • Jewellery, watches, precious stones
  • Antiques, artwork, collectibles
  • Precious metals (gold, silver, bullion)

5.2 Identity & Legal Documents

  • Passports, driving licences, government IDs
  • Birth/marriage certificates, legal papers
  • Titles, deeds, wills

5.3 Fragile & Breakable Goods

  • Glass, mirrors, ceramics, pottery
  • Liquids, oils, creams, gels
  • Perishable goods

5.4 Dangerous Goods

  • Aerosols, perfumes, solvents, paint
  • Batteries not in devices
  • Weapons, ammunition, fireworks
  • Chemicals, corrosives, toxic items

5.5 Customs-Restricted Items

  • Counterfeit goods
  • Pornographic materials
  • Sanctioned items
  • Items prohibited by IATA or destination customs

If sent, prohibited items may be: seized, destroyed, returned at your cost, or result in legal penalties.

NO compensation is payable for prohibited items under any circumstances.

6. Restricted Items (No Compensation)

The following may be carried but strictly at your own risk:

  • Mobile phones, tablets, laptops, electronics
  • Used items
  • Fragile items
  • Car parts
  • Cosmetics, perfumes
  • Musical instruments
  • Artwork prints
  • Items not in original manufacturer packaging

Claims for restricted items are automatically declined.

7. Packaging Requirements

You must package goods safely for international transit:

  • Strong, rigid, undamaged outer box
  • Adequate internal cushioning
  • Double-wall boxes for items over 5kg
  • Secure sealing
  • Correct labelling

If packaging is inadequate, all liability and compensation is void.

8. Dimensional Weight (Volumetric Charges)

We charge based on the higher of:

  • Actual weight
  • Volumetric weight (L × W × H ÷ 5000 or 6000 depending on service)

If a parcel is under-declared, you authorise Parcel Horse to automatically charge the difference.

9. Collection & Delivery

9.1 Transit Times

All times provided are estimates, not guarantees.

9.2 Delivery Methods

Parcels may be delivered:

  • To the receiver
  • To neighbour or reception
  • To a safe place
  • With photographic proof

We are not liable for theft after delivery is recorded.

9.3 Failed Delivery

If delivery cannot be completed:

  • The parcel may be returned at your cost
  • Storage fees may apply
  • Parcels may be abandoned or destroyed by overseas carriers

10. Customs, Duties & Import Regulations

10.1 Customs Delays

Customs processes are outside our control. We are not liable for:

  • Delays
  • Duties & taxes
  • Inspection fees
  • Seizures
  • Returns due to unpaid duties

10.2 Misdeclaration

Incorrect descriptions, values, or HS codes void all compensation and may incur fines.

11. Returns, Abandoned or Refused Parcels

If a parcel is:

  • Refused by the receiver
  • Unclaimed
  • Returned due to unpaid duties
  • Returned due to prohibited items

You are responsible for:

  • Return shipping
  • Duties and taxes
  • Storage fees
  • Disposal or abandonment fees

If unclaimed after 14 days, we may dispose of the parcel.

12. Surcharges

You may be charged additional fees for:

  • Weight/dimension discrepancies
  • Remote area delivery
  • Address corrections
  • Customs handling
  • Return to sender
  • Storage fees
  • Security screening
  • Airline surcharges

These may be billed automatically after shipment.

13. Right of Lien

Parcel Horse may withhold or dispose of parcels if any charges remain unpaid.

14. Standard Liability (Included Free)

If a parcel is lost or damaged due to our negligence or that of our carriers:

Our maximum liability is £50 per parcel, unless you purchase Declared Value.

We do not cover:

  • Indirect loss (profits, emotional loss, business loss)
  • Loss caused by customs
  • Delay of any kind
  • Loss due to incorrect declarations or packaging

15. Declared Value (Optional Enhanced Liability)

You may purchase an increased liability limit at checkout.

Declared Value:

  • Increases our maximum liability up to the purchased amount
  • Requires proof of value
  • Is void if the value is misdeclared
  • Is not insurance, but an extension of contractual liability

Maximum Declared Value Limit: £5000

16. Claims Process

16.1 Claim Deadlines

  • Loss: Report within 7 days of expected delivery
  • Damage: Report within 48 hours of delivery
  • Documents submitted within 14 days

16.2 Required Evidence

  • Proof of value
  • Packaging photos (inside & outside)
  • Damage photos
  • Proof of delivery or collection

16.3 Inspection Rights

We may collect the damaged goods before approving a claim.

16.4 Fraudulent Claims

Any fraudulent activity voids compensation and may lead to account closure or legal action.

17. Exclusions of Liability

We are not liable for:

  • Prohibited or restricted items
  • Inadequate packaging
  • Damage after delivery
  • Delay of any kind
  • Acts of God
  • Customs actions
  • Natural deterioration
  • Items without proof of value
  • Consequential or indirect losses

18. Subcontractors & Himalaya Clause

All protections, exclusions, and liability limits in these Terms extend to:

  • Our subcontractors
  • Our carriers
  • Their employees, agents, and partners

Customers may not hold subcontractors liable beyond our own liability limit.

19. Data Protection

We process personal data according to UK GDPR.

We share necessary shipment data with:

  • Carriers
  • Customs authorities
  • Security agencies
  • Payment processors

20. Sanctions & Export Compliance

We will not carry goods to/from any country subject to UK, EU, or UN sanctions.

Shipments may be stopped or returned if compliance concerns arise.

21. Force Majeure

We are not liable for losses caused by:

  • Weather
  • Natural disasters
  • Strikes
  • War or terrorism
  • Airline cancellations
  • Government action
  • IT or system failures

22. Limitation of Liability

Our total liability per parcel is capped at:

  • £50 (standard)
  • The Declared Value amount purchased

Nothing in these Terms limits liability for death or personal injury caused by our negligence.

23. Governing Law

These Terms are governed by English law.

Any disputes shall be resolved in the courts of England & Wales.

24. Amendments

We may update these Terms at any time.

The version on our website at the time of booking applies.
